Terms of service

These terms cover your use of the Pear application for macOS, sold by Phanthawas Jirakiattikun. Installing or using Pear means you accept them.

1. Licence

We grant you a personal, non-exclusive, non-transferable licence to install and use Pear on Macs you own or personally use, for as long as you comply with these terms.

A Pear 3 licence does not expire and includes every update within version 3.x that we publish. A future major version would be a separate purchase, at a discount for existing owners; your Pear 3 licence continues to work either way.

Your licence is a signed file tied to your email address. It is not for sharing, publishing or resale.

2. Free trial

Pear runs with every feature for fourteen days from first launch, without payment or an account. When the trial ends the tools stop working until a licence is entered. Content you created — notes, shelf items, saved screenshots — remains accessible and exportable.

4. Payment and tax

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders and handles all customer-service enquiries relating to payment, including tax. Prices are in US dollars and exclude tax, which is calculated at checkout where it applies.

Refunds are covered by the refund policy.

5. File deletion

Some tools in Pear remove files: clearing caches, reclaiming disk space, or deleting items you select. You are responsible for reviewing what you ask Pear to delete. Where possible, deletions go to the Trash and are shown to you before they happen. Keep backups: we are not liable for data you instructed the software to remove.

6. The pear command-line tool

The cleanup, disk and stats tiles are powered by pear, a separate program licensed under the GPL-3.0. It is free, open source, and installed by you. It is not part of the product sold here and is not covered by these terms.

7. Third-party components

Pear includes components under their own licences, including the Sparkle update framework, the BEN2 background-removal model (MIT, © Prama LLC), and the Space Grotesk and Fraunces typefaces (SIL Open Font Licence). Their notices are included in the app.

8. Warranty

Pear is provided as is. We test it and we intend it to be reliable, but we do not warrant that it will be uninterrupted or error-free, or that it will suit a particular purpose.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising from or relating to Pear is limited to the amount you paid for it. We are not liable for indirect or consequential loss, including lost data, lost profits or business interruption.

Nothing here limits liability that cannot be limited by law, including your statutory rights as a consumer.

10. Termination

You may stop using Pear at any time by deleting the app and your licence file. We may terminate a licence obtained fraudulently, charged back, or used in breach of section 3. A licence terminated despite being bought in good faith will be refunded.

11. Changes

These terms may change for future versions of Pear. The terms in force when you bought your licence continue to apply to that licence.

12. Governing law

These terms are governed by the laws of Thailand, whose courts have jurisdiction. This does not affect consumer-protection rights you hold where you live.
